Agreement to Terms

By accessing and using KovaFit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

Use License

Permission is granted to temporarily download one copy of the App for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained in the App
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

Subscription Terms

KovaFit Pro Subscriptions

KovaFit offers subscriptions to access premium features:

• Monthly Plan: €9.99 per month
• Yearly Plan: €69.99 per year (save 40%)

Auto-Renewal

Your subscription will automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions

You can manage and cancel your subscription at any time by going to your App Store account settings. Cancellations take effect at the end of the current billing period.

Refunds

All purchases are final. Refunds are handled by Apple according to their refund policy. We do not provide refunds for partial months or unused portions of subscriptions.

IMPORTANT: The information provided by KovaFit is for general informational purposes only. The App is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

• Always consult with a qualified healthcare provider before starting any new exercise program
• Never disregard professional medical advice or delay in seeking it because of something you have read in the App
• The AI Coach provides general fitness guidance and is not a certified personal trainer or medical professional
• If you experience any pain, discomfort, or other adverse effects during exercise, stop immediately and seek medical attention

Assumption of Risk

You acknowledge that physical exercise involves inherent risks of injury. By using KovaFit, you assume all risk of injury or harm that may result from your use of the App and its recommendations. You agree to use the App at your own risk and understand that we are not liable for any injuries or damages that may occur.

User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring that your use of the App complies with all applicable laws and regulations
• Providing accurate information about your health, fitness level, and goals
• Notifying us immediately of any unauthorized use of your account

Prohibited Uses

You may not use the App to:

• Violate any local, state, national, or international law
• Transmit any harmful, threatening, abusive, or offensive material
• Impersonate or attempt to impersonate another user or person
• Interfere with or disrupt the App or servers or networks connected to the App
• Attempt to gain unauthorized access to any portion of the App
• Use the App in any manner that could harm the App or interfere with any other party's use

Intellectual Property

The App and its original content (excluding user-generated content), features, and functionality are owned by KovaFit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use any of our trademarks, logos, or service marks without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall KovaFit, its affiliates, or their licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
